“CMA Investigates Companies for Online Pricing Strategies”

Investigations have commenced into eight companies due to concerns regarding their online pricing strategies, with an additional 100 businesses expected to receive warnings. The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.

The Competition and Markets Authority (CMA) is focusing its investigations on how fees are displayed online, potential misrepresentation of time-limited offers, and the automatic enrollment of customers in optional charges. Specifically, StubHub and Viagogo are being probed for additional charges associated with ticket purchases, while AA Driving School and BSM Driving School are under investigation for fee transparency on their websites.

Gold’s Gym is being examined for the presentation of a one-time joining fee for annual memberships, particularly how it is introduced during the signup process. Wayfair is being looked into for time-limited sales, Marks Electrical for default opt-ins, and Appliances Direct for their utilization of time-limited sales and default opt-ins.

The CMA stated that it suspects these companies may have violated consumer protection laws but emphasized that no final decisions have been reached yet. These cases mark the first instances where the CMA is utilizing its new consumer protection powers. The authority also plans to contact 100 other businesses regarding concerns about their use of additional fees and sales tactics.

According to CMA chief executive Sarah Cardell, ensuring transparent pricing and genuine sales is crucial for consumers, especially when financial pressures are high. Cardell emphasized the importance of protecting consumers from deceptive pricing and pressure selling, reiterating that businesses must adhere to fair practices.

An AA Driving School spokesperson expressed confidence in their fee transparency and willingness to enhance customer notifications. Viagogo also affirmed its cooperation with the CMA investigation.

The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. BSM Driving School is affiliated with the AA, while Viagogo and StubHub share the same parent company.
